Terms of Service


TERMS OF SERVICE
& PAYMENT

By commissioning me, you are agreeing to my terms of service automatically. Claiming you didn't read my TOS is not a valid reason to cause a dispute. It is your responsibility to have read and understood it.

Payment comes first. After I'm paid, you will enter my queue (visible on Trello) and then I will get started.
Turnaround is usually about a week for regular sized pieces and no more than a month. For noticeably larger pieces (group shots, animations, etc.), I can only estimate.
Please don't pay until I tell you to! I like to clarify most details & expectations prior to payment.
My prices are fluid and may change person-to-person depending on complexity, but usually they do not.


RIGHTS (PERSONAL / COMMERCIAL)

I have the default right to post and share the artwork I make for a commission publicly on social media. Please specify if you don't want your commission shared publicly / seen by anyone except you.
You cannot take credit for drawing the piece.
You may freely edit the piece within reason (color tweaks, putting effects/photos on top, cropping, etc.). Ask me for approval if you want to do major tweaks!

You can use the art for personal reasons (using it as an icon, reference, banner, etc.). Credit me within reason; you don't need to be strict about crediting every time it's put to use, but direct others to me if they ask!
You may print the piece for personal use (including on non-paper surfaces, using 3rd party printing services, but make sure the service is trusted).
You do NOT have commercial use of the piece. This means you cannot sell copies or use it in a way to earn money. You may only resell the piece if you are selling the content within the piece (such as selling your character). If you do want commercial use, please talk to me! I am open to sorting out a deal.


NFT / AI / "COMPLETING" / WATERMARK

You may not use my art to feed AI development.
You may not use my art as an NFT.
If there is a watermark on any of my work, you may not remove it.

Defaultly, if you receive an "incomplete" piece (such as a sketch page, or a flat color piece), you may not "complete" it with your own skills or tools behind my back. If you are interested in doing this, please talk to me! We can organize a collaboration or I can give you permission.
I simply don't want it done without my knowledge, but I am okay with the concept! :)


WORK IN PROGRESS & AFTER COMPLETION

If you want to see a work in progress (WIP) of the commission, I will ask which stage(s) you wish to see (sketching, lining, coloring).
Minor tweaks / reasonable edits are free at any stage!

If you don't respond after a WIP, I will not continue the commission until you have.
Speedpaints are free for any piece! I need to remember to turn it on before I start, so just ask if you want one!
After the commission is done, I can give you a copy of an earlier stage (such as flat colors for a shaded piece).
If you are utilizing my "In Your Hands" or Experiment discounts, you cannot get a WIP, but minor tweaks can be made at the end.


DESCRIPTION REFERENCES

(Feel free to skip this section if you have drawn references)
If you give me a description instead of a visual reference, you have to be as specific as possible. Anything not described will be up to me and I will not redo the commission for free if you are unsatisfied (however, I can do tweaks, such as adding a small accessory or changing a certain color).

I will not add accessories/traits that aren't described. If your description is too vague, I may prompt for more details.
Please specify if you want me to take creative liberties for any aspect.
You can also give me a "vibe" for the design so I can come up with traits that fit that style without needing you to explicitly tell me every detail.
Description references are NO EXTRA CHARGE! Just ensure they're good quality for me!


REFUNDING

You may only refund a piece if I haven't started it. Please talk to me if you intend to refund!

I may decide to cancel working on the piece at any time, for a full refund back to you, regardless of the stage of completion.
Essentially: If I cancel, full refund to you. If you cancel, you can only refund the full amount before I start.


COMMISSION DENIAL

I have the full right to decline your commission for any reason (with a full refund/lack of payment in the first place).

I will not draw blatantly sexual pieces. I don't mind drawing something suggestive or attractive, but I can and will decline overtly explicit, pornographic, and fetishistic commissions.
